Terms and Conditions
These Terms and Conditions ("Terms") govern your purchase, rental, calibration, repair, or use of equipment and services from Environmental Remediation Equipment Inc. ("ERE", "we", "us"). By submitting a purchase order, signing a quote, or accepting delivery from ERE, you agree to these Terms. Last updated May 2026.
Quotes and Pricing: Written quotes from ERE are valid for thirty (30) days from the date issued, unless otherwise specified on the quote itself. All prices are quoted in Canadian dollars (CAD) and are exclusive of applicable federal and provincial taxes, freight, insurance, customs duties, and brokerage fees. Pricing on quotations supersedes pricing on websites, printed catalogs, or prior correspondence. ERE reserves the right to update pricing prior to order acceptance to reflect changes in supplier costs, currency exchange, or product availability.
Orders and Acceptance: A binding order is formed when ERE issues a written sales order confirmation, sales invoice, or rental contract referencing the purchaser's order. ERE may decline or limit any order at its discretion, including for credit, inventory, regulatory, or end-use reasons. Special-order, non-stock, and custom-configured items (including custom filter bag dimensions, custom filtration housings, and made-to-order remediation systems) are non-cancellable and non-returnable once ERE has issued the supplier purchase order. Standard catalog items follow the Returns provisions below.
Terms of Payment: Terms of payment are Net 30 days with established credit. We also accept VISA, MASTERCARD and AMERICAN EXPRESS credit cards*. Invoices not paid within terms may accrue interest at 1.5% per month (19.56% per annum) on overdue balances. Customers without established credit may be required to prepay or provide a deposit prior to shipment. Applicable taxes (GST, QST, HST, PST) are added to all invoices based on the ship-to province.
Shipments: Freight is F.O.B. Montreal (E.R.E. Inc.) Appropriate charges (such as freight and insurance if specified), will be added to your invoice. These charges are determined (at time of shipment) by:
- Product plus packaging weight
- Overall package dimensions
Risk of loss and title pass to the purchaser when goods are delivered to the carrier at ERE's Montreal facility. Refer to the Shipping Terms for lead times, carrier handling, damage claims, and rental logistics.
Returns: Any returns must be made within 30 days of purchase. A 25% re-stocking fee will be applied, unless the product is under warranty and must be returned due to a manufacturer defect. A return authorization number must be issued, please contact customer service before returning. 1-888-287-3732. Items must be returned in original packaging, unused, and complete with all accessories, manuals, and calibration certificates where applicable. Return freight is the responsibility of the purchaser. Used, opened, calibrated-to-order, special-order, or hygiene-sensitive items are not eligible for return.
Warranties: Equipment sold by ERE carries the manufacturer's warranty for the period and scope specified by the original manufacturer. ERE passes through manufacturer warranties to the purchaser and will coordinate warranty claims, repairs, and replacements with the manufacturer on the purchaser's behalf. Calibration services performed by ERE are warranted to meet the calibration tolerances stated on the issued certificate at the time of release; calibration warranty does not cover drift, damage, or recalibration intervals after release. Rental equipment is supplied in operational, calibrated condition as documented on the rental dispatch; the renter is responsible for proper use during the rental period.
Limitation of Liability: Except as required by applicable law, ERE's total aggregate liability under any order, sale, rental, repair, or service shall not exceed the amount paid by the purchaser for the specific equipment or service giving rise to the claim. ERE shall not be liable for indirect, incidental, consequential, special, or punitive damages, including without limitation lost profits, lost data, project delays, environmental remediation costs beyond the equipment value, or third-party claims, regardless of the legal theory of recovery. Some jurisdictions do not allow these limitations; in such jurisdictions, ERE's liability is limited to the maximum extent permitted by law.
Customer Responsibilities: Selection of equipment for a specific application, calibration interval, intended use, and end-result is the responsibility of the purchaser. ERE provides technical guidance and equipment specifications in good faith, but the purchaser is responsible for verifying suitability for the intended environment, project conditions, applicable regulations, and operator training. Operators must read manufacturer instruction manuals and follow all safety procedures, certifications, and applicable workplace safety regulations (including CSA, CCOHS, and CNESST requirements as applicable).
Compliance and Dangerous Goods: Certain equipment supplied by ERE — including lithium-ion battery-powered instruments, calibration gas cylinders, certain remediation chemicals, and pressurized components — is classified as dangerous goods for transport under the Transportation of Dangerous Goods Regulations (TDG, Canada) and IATA. ERE will declare and document dangerous goods shipments in accordance with applicable regulations. The purchaser is responsible for compliance with all applicable import, export, end-use, environmental, and disposal regulations at the destination.
Intellectual Property: All trademarks, product photography, written specifications, catalog content, technical drawings, and proprietary documentation supplied by ERE remain the property of ERE or the respective manufacturers. The purchaser may use ERE-supplied materials internally for the purpose of operating, maintaining, and reordering equipment. Reproduction, republication, or commercial redistribution of ERE content (including the ERE website, technical bulletins, Field Notes blog, and the Sampson™ filtration brand) requires prior written consent.
Force Majeure: ERE shall not be liable for any delay or failure in performance arising from causes beyond its reasonable control, including without limitation acts of God, weather, fires, floods, labor disputes, strikes (including postal and carrier strikes), government actions, pandemics, supplier failures, transportation disruptions, or shortages of materials. In such events, ERE will use reasonable efforts to notify the purchaser and resume performance as soon as practicable.
Governing Law: These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles. The parties consent to the exclusive jurisdiction of the courts of the Province of Quebec, sitting in the judicial district of Montreal, for any dispute arising from or related to these Terms or any transaction between the parties. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Changes to Terms: ERE may update these Terms at any time by posting the revised version on www.ereinc.com. The "Last updated" date at the top of the page reflects the most recent change. Continued use of ERE services, or placement of new orders, after the effective date of any change constitutes acceptance of the revised Terms. Material changes will be communicated to active credit accounts in advance where reasonable.
